Retirement income tax
Social Security in New Mexico: Effective tax year 2022, Social Security benefits are FULLY exempt from New Mexico income tax for taxpayers whose federal adjusted gross income is below $100,000 (single), $150,000 (married filing jointly, head of household, or surviving spouse), or $75,000 (married filing separately). Taxpayers with federal AGI at or above these thresholds remain subject to NM income tax on Social Security to the extent it is included in federal AGI. Pensions, IRAs, and 401(k)s: New Mexico has a state income tax and generally taxes pension, IRA, and 401(k) distributions as ordinary income. There is no broad general exclusion for private pensions or IRA/401(k) income. Two limited provisions apply: (1) Persons 65 or older may claim an income exemption of up to $8,000 per taxpayer, phased out by income (Section 7-2-5.2 NMSA) — the full $8,000 is available only to lower-income seniors (roughly AGI under ~$28,500 single / ~$51,000 married filing jointly / ~$25,500 married filing separately) and phases down as income rises. (2) Military/uniformed-services retirement pay is exempt up to $30,000 for tax years 2024 through 2026 (Section 7-2-5.11 NMSA). Source: NM Taxation and Revenue Department.
