Retirement income tax
Social Security in West Virginia: West Virginia completed a phase-out of its tax on Social Security benefits. Prior law fully exempted benefits for filers with federal AGI of $50,000 or less (single) / $100,000 or less (joint); for higher earners a decreasing modification phased in at 35% (TY2024) and 65% (TY2025). Beginning tax year 2026, 100% of Social Security benefits are exempt from WV income tax for ALL filers regardless of income. (Also, historically WV only taxed Social Security to the extent it was includible in federal AGI.)
Pensions, IRAs, and 401(k)s: Pensions, IRA and 401(k) distributions are generally taxable, but several decreasing modifications apply: (1) $8,000 senior/disability modification — any taxpayer who is age 65+ during any part of the year OR permanently and totally disabled may deduct up to $8,000 of income from ANY source (each qualifying spouse on a joint return gets a full $8,000, i.e., up to $16,000). (2) $2,000 public-pension modification — any taxpayer (any age) may deduct up to $2,000 of benefits from the WV Teachers Retirement System, WV Public Employees Retirement System, and federal retirement systems (Title 4 USC §111). (3) WV state/local police, deputy sheriff, and firefighter retirement benefits (including survivorship annuities) are fully deductible.
